当該業者が請け負った山本正夫様屋根カーポート修繕工事において、当該業者の現場代理人にであった前川勝利氏は上記工事現場にて、地上から高さ２メートル以上の屋根上で、労働者にカーポートの屋根材に使用されているポリカーボネート波板の張替え作業を行わせるに当たり、同所は墜落により労働者に危険を及ぼすおそれがあるにもかかわらず、足場を組み立て、歩み板を敷くなどの方法により作業床を設けず、もって労働者が墜落するおそれのある場所に係る危険を防止するための措置を講じなかったことにより、当該業者及び同氏が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
