(1) The construction company violated Article 26, Paragraph 3 of the Building Business Act by assigning Mr. A, who was a dedicated chief technician at another construction site, as a chief technician without the qualification for building construction work, and also by having him serve as a site supervisor for another company. They also failed to assign a qualified chief technician and violated Article 22, Paragraph 1 of the same Act by having the entire contracted construction work undertaken by K-Tech Corporation. (2) The company also violated Articles 27-26, Paragraphs 2 to 4 of the Building Business Act in their application for management scale evaluation by falsely including the contract work from Toa Giken Kogyo Corporation as part of the completed construction cost in the construction history report, despite not actually performing the work, and submitted the resulting management review to Osaka City for qualification assessment related to general construction work.

建設業法第28条第３項

Cause of action

(1) 当該建設業者は、大阪市発注の工事（以下「本件工事」という。）において、建設業法第26条第３項の規定に違反して、他の工事現場に専任の主任技術者として配置されていたＡ氏を建築工事業の資格なく左官工事等の資格で専任の主任技術者として配置する（加えて同氏は他社の現場代理人となっている。）など適格な主任技術者を配置せず、同法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社ケイテックに請け負わせた。 (2) 当該建設業者は、経営規模等評価の申請において、建設業法第27条の26第２項から第４項までの規定に違反して、(1)のとおり、株式会社トーワ技研工業から請け負った本件工事を、建設業法第22条第１項の規定に違反して、一括して株式会社ケイテックに請け負わせていたが、当該工事を実質的に行っているとは認められないため当該工事の金額を完成工事高に含めて記載するべきではないところ、「工事経歴書」に、当該工事を施工したとして当該工事の金額が建築一式工事の完成工事高に含まれるとする記載をした。 これにより得た経営事項審査結果を大阪市に提出し、大阪市がその結果を建築一式工事に係る資格審査に用いた。
