株式会社釘虎は、平成３０年９月から１１月にかけて工事代金を請求した江戸川リフォーム工事において、重過失により相手方注文者が建設業の許可を受けていないことを確認せず、法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む者と法施行令第１条の２に定める金額以上となる下請契約を締結した。 このことが、法第２８条第１項第６号に該当する。
