株式会社ダイケンシステムの職長は、同社の業務に関し、令和５年２月23日、横浜市保土ヶ谷区権太坂一丁目77番２号ないし85番３号における令和３年度今井川改修工事現場において、労働者に、クレーン機能付きドラグ・ショベルを使用してフレコンバックの移動作業を行わせるに当たり、移動式クレーンの転倒等による労働者の危険を防止するため、あらかじめ、当該作業に係る場所の広さ、地形及び地質の状態、運搬しようとする荷の重量、使用する移動式クレーンの種類及び能力等を考慮して、移動式クレーンによる作業の方法を定めなければならないのに、これを定めずに作業を行わせ、もって機械等による危険を防止するため必要な措置を講じなかったものである。 このことにより、株式会社ダイケンシステムと同社職長に対し、罰金20万円の罰金刑が確定した（横浜簡易裁判所 令和６年５月20日略式命令）。 このことは建設業法第28条第１項第３号に該当する。
