Cause of action

１ 当該建設業者は、大阪府が発注者である大阪市内の工事（以下「本件工事」という。）において、それぞれの専門工事において建設される目的物について、それのみを解体する工事は各専門工事に該当するため内装解体工事は内装仕上工事業に該当するところ、建設業法第３条第１項の規定に違反して、内装仕上工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。 ２ 当該建設業者は、大阪市内及び岡山県岡山市内の民間発注の工事並びに本件工事において、注文書を株式会社天雫に発行し、同社から発行された請求書を受けて、銀行口座の名義が「㈱天雫 ホウショウ事業部」である同社の口座に振り込むことにより、請負代金を同社に支払っており、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む株式会社天雫と下請契約を締結した。
