ＢＨＷ株式会社の代表取締役は、大仙市高梨地内の貸家軒補修工事現場に架設されていた作業床において、労働者に補強用木材の設置等作業を行わせるに当たり、同作業床付近には、電圧１００ボルトの架空電線の充電電路である引込線が近接する状態で架設されており、同労働者の身体が同引込線に接触又は接近することにより感電の危険が生ずるおそれがあったにもかかわらず、同引込線に絶縁用防護具の装着するなどの危険を防止するための必要な措置を行わなかった。 これにより、同社及び同社代表取締役は、令和５年８月３日、大曲簡易裁判所から労働安全衛生法違反の罪によりそれぞれ罰金１５万円の略式命令を受け、同年８月２２日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
