有限会社浜本組は、令和3年3月4日、出ノ上川砂防堰堤工事において、労働者を使用してコンクリート製の堤防の側面の筋彫り作業を行わせるに当たり、当該作業場所は地上から2メートル以上あり、墜落により労働者に危険を及ぼすおそれがあり、かつ、地上から足場を組む等の方法により作業床を設けることが容易であったにもかかわらず、これを設けず、労働者が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかった。 この件について、貴社及び貴社工務課長に対し、米子簡易裁判所から労働安全衛生法違反による罰金刑の略式命令があり、令和3年9月30日にその刑が確定している。 このことは、建設業法28８条第1項3号に該当する。
