アース環境開発は、奈良県葛城市内の民間工事において、建設業法第３条第１項に基づく建設業許可を受けることなく、建設業法第３条ただし書き及び建設業法施行令第１条の２第１項に規定する軽微な建設工事以外の工事を請け負った。 このことが、建設業法第２８条第２項第２号に該当すると認められる。
