On December 29, 2021, at a demolition site in Kusanami-cho, Konan City, the director of Adachi Home Co., Ltd. acted as a work supervisor for the demolition of a steel-frame building over 5 meters high. However, the director did not directly supervise the demolition work nor perform the duties prescribed by the Ministry of Health, Labour and Welfare Ordinance for work supervisors, such as commanding workers engaged in the demolition. This constituted a violation of the Labour Safety and Health Law. As a result, the company and its director received a summary order imposing a fine of 200,000 yen from the Ichinomiya Summary Court, and the penalty was finalized. This action is based on Article 28, Paragraph 1, Item 3 of the Construction Business Act. The Aichi Prefectural Government issued a directive requiring the company to take measures to prevent recurrence, including promptly informing staff of the incident and the penalty, strengthening safety management systems at workplaces and subcontractors, continuing compliance with relevant laws, and creating and implementing safety education and guidance plans for employees.

Cause of action

株式会社アダチホームの取締役は、江南市草井町地内の解体工事現場における鉄骨造建築物の解体等作業主任者として労働者の指揮監督及び安全管理等を行っていたものであるが、同社の業務に関し、令和３年12月29日、同工事現場において、労働者らをして、高さが５メートル以上の鉄骨造建築物の解体作業を行わせるに当たり、前記作業主任者として同解体作業を直接指揮せず、もって作業主任者に当該作業に従事する労働者の指揮その他厚生労働省令で定める事項を行わせなかったものである。 このことが、労働安全衛生法に違反し、一宮簡易裁判所より、法人及び取締役が罰金20万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第１項第３号に該当する。
