株式会社川田住建が建設業法第１７条の２第１項の規定により建設業者としての地位を承継した川田住建は、三郷町内の工事において、建築工事業に関する特定建設業の許可を受けることなく、建設業法第３条第１項第２号の政令で定める金額以上で下請契約を締結した。このことが、建設業法第２８条第１項第２号に該当する。 また、同工事を、建設業法第２２条第１項に違反して、一括して当該契約による下請負人に請け負わせた。このことが、建設業法第２８条第１項第４号に該当する。
