当該建設業者は、令和３年12月17日に豊中市に対して行った入札参加資格審査申請において、「入札参加資格審査申込書（建設工事）」に事務所の所在地を「大阪府豊中市蛍池西町２－13－10－405」と記載し、当該事務所に固定電話等の事務機器及び契約印を置き、社員３人が午前９時から午後５時まで（営業活動等で外出し、事務所が留守となる時間帯を除く。）在席するなどと記載した「市内事業者の認定に係る事務所等実態報告書」並びに当該事務所の玄関扉に標識を貼り付けた外観の写真及び充電器に設置された電話機などの内部の写真（同年11月16日に撮影）を貼り付けた「所在地等調書（事務所の形態１(外観)・２（内部））」（以下「事務所等実態報告書」という。）を添付して、「市内事業者の認定に係る誓約書」により事実と相違ないことを誓約していたにもかかわらず、実際には当該事務所における電気使用量が少なくとも同月５日から令和４年２月３日までの間は０kWhであり、同年３月２日及び同月８日には玄関扉（外側）にも郵便受けにも令和３年11月16日には貼られていた標識が貼られていない状態であった。 当該建設業者は、このように当該事業所の実態と相違する事務所等実態報告書を豊中市に提出し、事務所等実態報告書と当該事務所の実態が相異する状態が続いていたにもかかわらず同年５月19日まで入札参加資格審査申請を取り下げないなど公共工事の入札及び契約手続きについて不正行為等を行った。
