The respondent: (1) Did not submit a change notification as required by Article 9, Paragraph 1 of the Act against Unjustifiable Premiums and Misleading Representations, after a licensed real estate agent they appointed as a full-time real estate transaction agent at their main office on February 1, 2022, ceased to meet the full-time requirement due to a change in employment status by March 1, 2022. (2) Regarding the full-time real estate transaction agent, from the license date of December 16, 2019, at the main office and Osaka branch (a subordinate office), the number of installed agents did not meet the requirements stipulated in Article 31-3, Paragraph 1 of the Act. After the establishment of additional offices in Fukuoka and Kumamoto (licensed on September 16, 2022, and July 18, 2024, respectively), these offices also failed to meet the requirements from their establishment dates onward (excluding the period from February 1 to February 28, 2022, at the main office). Furthermore, at these four offices, the respondent did not take the necessary measures as prescribed in Article 31-3, Paragraph 3 of the Act. These actions violate the provisions of Article 9, Paragraph 1, and Articles 31-3, Paragraphs 1 and 3 of the Act.

被処分者は、 （１）主たる事務所において、令和４年２月１日に専任の宅地建物取引士として設置した宅地建物取引士について、令和４年３月１日時点で雇用形態の変更により専任要件を満たさなくなっていたにも関わらず宅地建物取引業法第９条第１項に規定する変更届を提出していなかった。 （２）専任の宅地建物取引士に関し、免許日である令和元年１２月１６日以降、主たる事務所及び、従たる事務所である大阪支店において、法第３１条の３第１項に規定する設置数を満たしておらず、免許取得後に設置された従たる事務所である福岡支店、熊本支店においても事務所設置日（令和４年９月１６日、令和６年７月１８日）以降、同様の状態であった（主たる事務所の令和４年２月１日から令和４年２月２８日の期間を除く）。また、これらの４事務所において、法第３１条の３第３項に定める必要な措置を取らなかった。 以上の行為は、法第９条第１項、法第３１条の３第１項及び３項の規定に違反する。
