山本住宅建設は、令和2年6月10日、長崎県諫早市小川町の個人住宅の新築工事現場において、同社実質代表者は自ら行う注文者として同工事の下請事業場の労働者に対して塗装作業において足場を使用させるに際し、高さ3．2メートルの足場床において墜落により労働者に危険を及ぼすおそれがあり、かつ開口部に手すり等を設けることが容易であったにもかかわらず、その措置を講じず作業を行わせた結果、労働者が重篤な障害を伴う怪我を負った。 このことにより、諫早簡易裁判所より、山本住宅建設実質代表者は労働安全衛生法違反により、罰金20万円の略式命令を受け、令和3年12月10日にその刑が確定した。 このことが、建設業法第28条第1項第3号に該当し、監督処分の対象となる。
