令和５年１２月１８日、（株）ミツヤマは、ベルトコンベヤーの運転中にコンクリートがらに含まれる木くず等のごみを選別する作業を行わせるにあたり、労働者の身体の一部が巻き込まれる等労働者に危険が生ずるおそれがあるにも関わらず、非常の場合に直ちにベルトコンベヤーの運転を停止することができる装置を備えず、もって、機械・器具その他の設備による危険を防止するための必要な措置を講じなかった。 労働安全衛生法第２０条第１号及び労働安全衛生規則第１５７条第１項に違反するとして、柳井簡易裁判所から（株）ミツヤマ及び代表取締役の密山一雄の両名がそれぞれ罰金２０万円の略式命令を受け、令和６年８月２日に刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
