ハーレーダビッドソンジャパンは、特定ディーラーに対し、自社登録を行わなければ達成できないようなＲＳＯを一方的に決めて、当該ＲＳＯに従って事業活動を行うことを余儀なくさせていた。合意書に記載するＲＳＯの案に関して協議を行わず、十分な説明もなく署名押印済みの合意書を提出させていた。特定ディーラーに対し、ＲＳＯの達成率を上げるように強く要請し、改善計画の作成や面談を強要していた。
