有限会社安斎技建の専務取締役は、代表取締役不在時における労働者の安全管理を担当する者である。同社の業務に関し、法廷の除外自由がないのに、令和２年８月１１日、福島県二本松市下川崎字町畑２３番１に所在する同社の加工場において、同社の労働者をして、車両系荷役運搬機械等であるフォークリフトを用いて積み上げられた型枠の資材を整理する作業を行わせるにあたり、同社の専務取締役が運転するフォークリフトの乗車席以外であるフォークに同労働者を乗せ、かつ、同労働者に積み上げられた型枠の資材を整理する作業を行わせるため、車両系荷役運搬機械等であるフォークリフトを使用させるに当たり、同社の専務取締役が運転するフォークリフトに同労働者を乗せフォークを上げた状態で走行して、フォークリフトを主たる用途以外の用途に使用し、もって、機械、器具その他の設備による危険を防止するため必要な措置を講じなかった。 本件災害により、同労働者は走行中のフォークリフトが横転したことでフォークから地面に墜落し、第一腰椎破裂骨折、脊髄円錐部損傷等を負った。 このことにより、貴社に対し罰金２０万円、専務取締役に対し罰金５０万円の刑が確定したもの。
