有限会社松於組は、椎葉村発注の村道畑線・畑工区道路改良工事において、建設業法第３条第１項の規定に違反してとび・土工工事業の建設業許可を受けていないにもかかわらず、建設業法施行令第１条の２第１項に定める軽微な工事の範囲を超える請負契約（下請契約）を締結した。このことは、建設業法第28条第２項第２号に該当する。
