当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、建設業法第26条第1項の規定に違反して、当該工事現場における建設工事の施工の技術上の管理をつかさどる者を配置せず、下請負人に対する現場作業に係る実地の技術指導、元請負人との協議、下請負人からの協議事項への判断・対応などを主として行わないなど自ら施工計画の作成、工程管理、品質管理、安全管理、技術的指導等を主として行わず請け負った管工事の主たる部分を東進に請け負わせており、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して同人に請け負わせた。 また、本件工事及び茨木市内の民間発注工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む株式会社一六八建設と下請契約を締結した。
