１ 当該建設業者の元代表取締役は、当該建設業者の業務全般を統括する立場にあって当該建設業者の代表取締役であった当時、家屋の修理検査のため、訪問した住宅で自ら家屋を損壊したのに台風に起因するかのように装い、損害保険契約を締結していた保険会社から請求を代行する会社に保険金を振り込ませて騙し取ろうと考え、当時当該建設業者の従業員であった者と共謀のうえ、 (1) 平成31年３月25日から令和元年７月22日までの間にバール等でスレートを損壊し、損害額97万3,728円を生じさせ、台風により損害が生じた旨の内容虚偽の見積書及び保険金請求書を保険会社に提出し、同社社員に正当な保険金であると誤信させ、令和元年８月６日、147万9,222円を口座に入金させた。 (2) 訪問した共同住宅４棟においてバール等でスレートを損壊し、損害額537万7,363円を生じさせ、台風に起因するかのように装い、内容虚偽の見積書及び保険金請求書を保険会社に提出し、同社社員に正当な保険金であると誤信させ、令和元年12月17日に663万893円を口座に入金させた。 (3) 家屋の修理検査のため、訪問した住宅で自ら家屋を損壊したのに台風に起因するかのように装い、内容虚偽の見積書及び保険金請求書を保険会社に提出し、同社社員に正当な保険金であると誤信させ、令和２年７月21日、152万6,007円を口座に入金させた。 (4) 令和２年９月14日、家屋の修理検査のため、訪問した住宅において自らバール等で家屋を損壊し、損害額91万8,500円を生じさせ、令和元年10月12日の台風により損壊したとの内容虚偽の見積書及び保険金請求書を保険会社に提出したが、調査会社に不正請求であることを見破られ、目的の達成を遂げなかった。 ２ これらのことで、当該建設業者の元代表取締役は、刑法（明治40年法律第45号）第246条第１項の罪、同項及び同法第250条の罪並びに同法第260条前段の罪により、懲役２年６月の刑に処せられ、令和４年８月13日にその刑が確定した。
