令和６年６月２６日から６月２８日まで、貴社に対して保安監査を実施したところであるが、監査の結果、改善を要する事項が認められたことから、下記の事項について、改善措置を講ずるよう指示する。講じた措置については、令和６年１１月１８日までに報告されたい。記１．令和６年２月に実施した軌道変位検査の結果に基づく補修が内規で定める期間以内に実施されておらず、更には前回の保安監査における改善措置が適確に実施されていない状況を確認した。また、今回の監査において、軌道の保全について輸送の安全にかかる管理の徹底がされていないことも確認した。よって、軌道の適切な保全を行うため、検査結果より補修計画を策定し、この計画に基づき確実に補修を行うとともに、適切な管理ができるよう必要な措置を講じること。併せて、軌道の保全業務の実施方法及び管理方法について検証し、法令等に基づく業務が確実に遂行されるよう体制等の見直しを図るとともに、見直しにあたっては、専門機関等の積極的な活用を検討すること。２．車両構造心得第２１条に規定する、車内内張に貼付するラッピングフィルムについて、燃焼性規格が不明な材料を使用していることを確認した。よって、同基準に基づき速やかに火災対策を講じるとともに、車両の火災対策について、車両担当者に対して教育を実施し、今後適切な管理ができるよう必要な措置を講じること。３．鉄道に関する技術上の基準を定める省令第１０条第２項に規定する列車等の運転に直接関係する作業を行う係員に対する知識及び技能を保有していることの確認の一部について、実施方法が明確でなく実施結果の記録がされていないことを確認した。よって、知識及び技能の確認について、実施方法を検討したうえで確実に実施し、実施結果を記録すること。４．保守用車（軌陸車）を使用して行う工事において、運転取扱心得第３１条の規定による「保守用車使用手続き（規程）」でなく、「トロリ使用手続（規程）」により実施していることを確認した。よって、保守用車を使用する工事又は作業は「保守用車使用手続（規程）」により実施するとともに、規程を誤って理解しないように関係者に教育を実施すること。これらの指示に従わず、安全管理体制の改善が確認できない場合や、再び違反行為があった場合には、以下のとおり、事業の改善を命ずる場合がある。（１）事業改善命令を行使し得る根拠となる法令の条項（行政手続法第３５条第２項第１号）鉄道事業法第２３条（２）上記の条項に規定する要件（行政手続法第３５条第２項第２号）鉄道事業法第２３条の鉄道事業者の事業について、輸送の安全その他公共の利益を阻害している事実があると認められること。（３）当該権限の行使が上記の要件に適合する理由（行政手続法第３５条第２項第３号）輸送の安全その他公共の利益を阻害している事実が確認され、鉄道事業法第２３条第１項第３号及び第６号で定める措置を講ずる必要があるため。以上【関東運輸局】
