佐藤建設工業は、代表者が刑法第204条違反により、新潟簡易裁判所から罰金50万円の判決を受け、平成31年１月29日に刑が確定し、建設業法第８条第８号に規定する欠格要件に該当していたにもかかわらず、令和２年２月６日付けの建設業許可申請書に、欠格要件には該当しない旨を記載した誓約書及び賞罰がない旨を記載した略歴書を添付し、不正の手段により同年２月26日に建設業の新規許可を受けた。 このことが、建設業法第29条第１項第７号に該当すると認められる。
