令和５年４月１１日に本線越中荏原駅～越中三郷駅間において、列車が作業に従事していた貴社の保線作業員に接触し、その後、保線作業員が死亡する鉄道人身障害事故を発生させた。 本事故を踏まえて、貴社に対して、令和５年４月１７日及び１８日に保安監査を実施したところ、記１．及び記２．のとおり改善を要する事項が認められたことから、記３．のとおり所要の措置を講ずるよう指示する。 改善措置を講ずるにあたっては、背後要因を含め当該事故が発生した原因を究明したうえで、再発防止に必要な改善策を策定するとともに、輸送の安全に係る業務が確実に実施できるよう留意すること。 なお、講じた措置については、令和５年７月７日までに報告されたい。 記 １．貴社は、技術関係従事員の触車事故を防止するため、安全上必要な措置等について、鉄道・軌道事業安全管理規程第２４条の関係規程として「技術関係従事員触車事故防止要領」（以下「事故防止要領」という。）を策定している。しかしながら、事故防止要領の遵守状況について確認したところ、以下の事実を確認した。 （１）列車見張員関係 ① 事故防止要領では、列車見張員は列車見張りの業務に専念し、列車等が接近した場合、直ちに作業責任者に待避の通報又は合図を行わなければならないと規定されているが、列車見張員は合図旗等を携行することなく、レールのジャッキアップやバラストの補充等の軽作業を行っており、作業責任者に待避の通報等を行わなかったこと。 ② 事故防止要領では、列車見張員の見張り位置について、見通し距離を５００ｍ確保することと規定されているが、見通し距離は約１００ｍ～２００ｍであったこと。 ③ 事故防止要領では、見通し距離が確保できない場合は、中継見張員を配置することと規定されているが、上記②のとおり見通し距離が確保されていないにも関わらず、中継見張員を配置していなかったこと。 ④ 事故防止要領では、作業集団直近の列車見張員の立哨位置は、作業集団から約１０ｍ離れた位置と規定されているが、バラストの補充等の軽作業を行うため、作業集団に近接した約１～２ｍの位置であったこと。 （２）作業責任者関係 ① 事故防止要領では、作業責任者は作業表示標を作業箇所の前後２００ｍかつ運転士から見やすい位置に建植しなければならないと規定されているが、作業表示標を建植していなかったこと。 ② 事故防止要領では、作業責任者は列車見張員を兼務してはならないと規定されているが、作業責任者は列車見張員を兼務していたこと。 （３）点呼執行者関係 事故防止要領では、点呼執行者が乗務員の点呼時において、線路内作業及び作業位置等を周知することが規定されているが、点呼執行者は当該列車の乗務員に周知していなかったこと。 ２．実施基準管理規程第１０条に基づく教育及び訓練について、作業責任者等に対して、事故防止要領を網羅した教育及び訓練を実施していなかったことを確認した。 さらに、「作業時における触車事故の防止について」（平成１０年１月２２日付け中運鉄運第１２号、中運鉄技一第２号、中運鉄技二第７号）において、列車見張員は列車見張りに専念させ、その他の作業に従事させないことと通達していたにもかかわらず、列車見張員がバラストの補充等の軽作業を行うことが常態化していたことを確認した。 ３．上記のとおり、今般、貴社において鉄道輸送の安全に影響を及ぼす重大な違反行為が生じたことについて、安全管理体制が有効に機能していないことが認められたことから、以下のとおり所要の措置を講ずることを指示する。 （１）同安全管理規程第２４条に規定する事故防止要領や関係規程が形骸化していないか実態を検証した上で、事故防止要領等を必要により見直すこと。 なお、事故防止要領等を見直す場合にあっては、「軌道内等の作業における列車との接触災害防止のためのガイドライン」（平成１１年９月１７日付け中運鉄運第１８７号、中運鉄技一第１１０号、中運鉄技二第８４号）を再認識し、当該ガイドラインの趣旨の徹底を図り対応策を講じること。 （２）本事故を踏まえ、作業責任者等に対して触車事故防止に関する安全意識の再徹底並びに事故防止要領等の遵守に係る教育を行うこと。 （３）二度と同種事故を再発させないために、線路内に立ち入る作業等を行う場合の安全確保に係る管理体制について検証し、触車事故防止が確実に遂行されるよう安全管理体制の見直しを図ること。 以上 【北陸信越運輸局】
