光建設株式会社は、令和３年10月14日に特定営業所技術者を変更したにも関わらず、事実発生日から２週間以内にその者に係る届出を提出しなかった。また、土木工事業、舗装工事業、しゅんせつ工事業及び水道施設工事業を令和３年10月14日に廃業したにも関わらず、事実発生日から30日以内に廃業届を提出しなかった。これらのことは、建設業法(昭和24年法律第100号) 第17条の規定により読み替えて準用する同法第11条第４項及び同法第12条（第５号該当）に違反し、同法第28条第１項に該当することより、指示処分の対象となる。
