（有）赤木硝子店は、令和2年9月23日、対馬市豊玉町に所在する民間事業者の倉庫における倉庫補修工事にて設置された足場において、倉庫の補修のために使用するスレート製の屋根材を運搬する作業を行う労働者Ａが、入院加療が１か月以上必要な右腓骨遠位端骨折により、4日以上休業することとなったため、遅滞なく対馬労働基準監督署長に対し、労働者死傷病報告を提出しなければならないのに、令和3年7月20日に至るまで労働者死傷病報告を提出しなかった。 このことにより、壱岐簡易裁判所より、（有）赤木硝子店及び同社代表取締役は労働安全衛生法違反により、それぞれ罰金20万円の略式命令を受け、令和4年1月5日にその刑が確定した。 このことが、建設業法第28条第1項第3号に該当し、監督処分の対象となる。
