Cause of action

株式会社大林組が、共同企業体の代表者として請け負った山梨県南巨摩郡富士川町におけるトンネル新設工事において、令和６年１２月２５日、鰍沢労働基準監督署による立ち入り検査を受け、同年１０月４日に発生した作業員に対する労働災害発生状況に関して質問された。 その際、真実は、前記労働災害がフォークリフトを定められた用途以外に使用したことにより生じた事故によるものであった可能性を認識していたにも関わらず、前記作業員が高所作業車上で作業していた際に同車両から転落して生じた事故によるものであった旨うそを言うとともに、同労働基準監督署労働基準監督官らの面前で、関係者に、前記作業員が高所作業車上で作業していた際に同車両から転落した事故状況を再現させるなどし、もって労働基準監督官の質問に対して虚偽の陳述をした。 この件について、令和８年３月２４日、鰍沢簡易裁判所から同社及び同社の社員２名が労働安全衛生法違反で略式命令（いずれも罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
