当該建設業者の代表者が、令和２年９月10日頃から同月26日頃までの間に、岩手県奥州市江刺伊出字新田171番地において、家屋の解体工事に伴って生じた産業廃棄物であるがれき類等約3,233キログラム及び一般廃棄物である廃タイヤ約1,568キログラムを土中に埋めて捨てたことが、廃棄物の処理及び清掃に関する法律違反にあたるとして、代表者が盛岡地方裁判所から懲役１年６月及び罰金70万円の判決を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
