当該建設業者が請け負った片倉コープアグリ株式会社宮古化成工場屋根葺替工事において、当該業者の代表取締役であった佐々木 勝久氏は労働者にスレート屋根上で作業を行わせるに際し、当該作業場所は踏み抜きによる労働者に危険を及ぼすおそれがあるにもかかわらず、歩み板を設け、防網を張る等踏み抜きによる労働者の危険を防止するための措置を講じなかったことにより、当該業者及び同氏が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。このことが、建設業法第28条第１項第３号に該当すると認められる。
