株式会社長里建設は、令和３年１０月３０日、諫早市から受注した「坂ノ下農地外９箇所災害復旧工事」の現場内において、車両系建設機械を用いて法面を掘削し、掘削後の穴底に設置された型枠内に生コンクリートを打設する際に、誘導者を配置することなく作業を行った。このことにより作業員に危険が生ずるおそれのある箇所に、作業員を立ち入らせ、機械による危険を防止するため必要な措置を講じなかった結果、作業員と車両系建設機械のバケット部分が接触し、作業員が死亡したことが判明した。株式会社長里建設及び当該工事の現場代理人は労働安全衛生法違反により、法人は罰金２０万円、当該工事の現場代理人は罰金３０万円の略式命令を受け、令和５年２月１７日にその刑が確定した。このことが、建設業法第２８条第１項第３号に該当し、監督処分の対象となる
