鈴木工務店は、発注者と住宅を新築する建設工事の請負契約を締結し、同請負契約に基づき同社に新築住宅を引き渡しているが、特定住宅瑕疵担保責任の履行の確保に関する法律（平成19年法律第66号）第３条第１項に規定する住宅建設瑕疵担保保証金の供託又は同条第２項に規定する住宅建設瑕疵担保責任保険契約の締結をせず、同法第４条第１項の規定による都道府県知事への届出も行わなかった。 このことが、法第28条第１項前段及び同項第９号に該当するため
