当該建設業を営む者は、株式会社豊が発注者から請け負った大阪市内の民間発注の店舗・共同住宅の解体工事（以下「本件工事」という。）において、株式会社豊の取締役が軽微な手続きのために発注者の代表者の印鑑の作成を発注者から許されたことをきかとして、発注者の了解なく発注者から当該建設業を営む者が請負代金１千万円（本件工事で発生する１千万円相当の有価物と相殺）で本件工事の一部（躯体の解体工事及びガラの撤去）を請け負ったとする工事請負契約書を、同印鑑を押印して作成し、その契約書に基づいて、建設業の許可を受けていない当該建設業を営む者が躯体の解体工事を施工していたところ、隣接するホテルの外壁を一部損壊させたほか、当該取締役が鉄板などを敷かずガラの上に配置された解体工事用クレーンの操作を誤って同クレーンを転倒させ、そのアームが道路を挟んだ南側の建物に倒れ掛かかってその建物の一部を損壊し、付近の停電及び火災を発生させるなど、建設工事を適切に施工しなかったために公衆に危害を及ぼした。
