山口工務店は、少なくとも平成27年度から令和４年度までの間に、複数の発注者と住宅新築工事の請負契約を締結し、発注者に新築住宅を引き渡しているが、履行確保法第３条で定める資力確保措置を講じていなかった。 また、その間、同法第４条第１項で定める知事への届出も行わなかったにもかかわらず、同法第５条で定める基準日の翌日から起算して50日を経過した日（平成28年５月21日）以後において、新たに、発注者と住宅を新築する建設工事の請負契約を締結していた。 このことは、履行確保法第３条第１項及び同法第５条に違反し、もって建設業法第28条第１項第９号に該当する。
