Yamaguchi Komuten entered into multiple contracts for new residential construction with various clients between fiscal year 2015 and fiscal year 2022 and delivered the newly built homes to the clients. However, they did not implement the financial capacity measures required by Article 3 of the Act on Securing Performance of Construction Work. Furthermore, despite not submitting the notification to the governor as stipulated in Article 4, Paragraph 1 of the Act, they entered into new contracts for residential construction with clients after May 21, 2016, which is 50 days after the designated date according to Article 5 of the Act. This constitutes a violation of Articles 3, Paragraph 1, and 5 of the Act on Securing Performance, and falls under Item 9, Paragraph 1, Article 28 of the Building Business Act.
