建設業の許可を受けないで建設業を営む松蔭塗装(株)は、福岡県発注の公共工事において、他人の許可通知書の写しに改ざんを行い、あたかも真正な許可通知書を原形どおりに正確に複写したかのような形式・外観を有する写しを作成し、それを一次下請業者であった建設業者に提示することで許可業者であると誤信させ、令和４年６月23日に同法施行令第１条の２第１項で定める軽微な建設工事の範囲を超える下請負契約を締結した。 以上のことは、建設業法第３条第１項に違反し、同法第28条第２項第２号に該当する。
