新潟県妙高市白山町で同社が請け負った山田住宅車庫シャッター補修塗り現場において、平成31年２月７日、同社の労働者がシャッターの塗装作業中に脚立から降りた際に左足踵及び左肋骨を骨折し、４日以上の休業を要する労働災害が発生した。しかし、同社は同現場の所在地を管轄する上越労働基準監督署長に対し、令和３年６月２日に至るまで法令に定める報告をしなかった。 このことを原因とし、同社及び同社代表社員が、労働安全衛生法違反により、高田簡易裁判所から罰金刑を受け、令和４年１月５日にこの刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
