有限会社林材木店（以下「本件建設業者」という。）の代表取締役である林四郎は、本件会社の業務に関し、法定の除外事由がないのに、令和２年１０月１６日午前８時頃、白井市神々廻字新駒２６１番地３本件建設業者に係る敷地内において、廃棄物である木くず約１８キログラムを焼却した。 当該事実に基づき、佐倉簡易裁判所から令和３年３月５日付け令和３年（い）第７６号略式命令において、本件建設業者及びその代表取締役である林四郎は、廃棄物の処理及び清掃に関する法律違反により、それぞれ罰金１０万円の刑に処された。 このことが、建設業法第２８条第１項第３号及び同条第３項に該当すると認められる。
