貴社所属の運転士１名（以下「当該運転士」という。）が、仕業前のアルコール検知器を用いた検査を行わないまま、他の者が検査を替わり不正に合格として、列車又は車両（以下「列車等」という。）を操縦していた旨、令和６年１月１５日に貴社から当局に報告があった。これを受けて、令和６年１月１７日に保安監査を実施したところ、下記のとおり改善を要する事項が認められたことから、改善措置を講ずるよう指示する。改善措置を講ずるにあたっては、当該事項に係る業務の実施方法、実施状況、管理方法等の妥当性について検証する等により、背後要因を含め当該事項が発生した原因を究明したうえで、再発防止に必要な改善策を策定するとともに、鉄道輸送の安全に係る業務が確実に実施できるよう留意すること。なお、講じた措置については、令和６年３月８日までに報告されたい。記１．運転取扱実施基準第９条の２に酒気帯びの有無の確認は、点呼執行者が運転士に対して仕業前後に対面で目視等によるほか、アルコール検知器を用いることと規定しているが、仕業前の点呼の際のアルコール検知器を用いた検査について、以下のとおり適切に行うことなく、当該運転士に列車等を操縦させていたことを確認した。（１）当該運転士は、点呼執行者が駅ホームで出発指示合図等のために駅務室を離れている間に、車掌にアルコール検知器を用いた検査を身替わりさせ、これを長期間繰り返し行っていた。（２）令和５年１０月１９日、当該運転士は、アルコール検知器を用いた検査を行った際、アルコールが検出される可能性があるため当該検知器の電源を切った。この行為を確認した点呼執行者から、再検査を指示されたにもかかわらず、これを拒否した。点呼執行者は、運行に支障をきたすと判断し、自らアルコール検知器を用いた検査を替わりに行った。よって、関係係員に対して、飲酒に関する安全意識の徹底並びに法令及び規程等の遵守に係る教育を実施するとともに、本社が現場の状況を的確に把握する体制を整備した上で、現場の実施状況を定期的に検証して、課題を整理し、必要な改善を行うとともに、改善の実効性が確保されるよう安全管理体制の強化を図ること。２．通達「鉄道に関する技術上の基準を定める省令等の解釈基準について」Ⅱ－１第１０条関係４において、鉄道に関する技術上の基準を定める省令第１０条に規定する列車等の運転に直接関係する作業を行う係員（以下「運転係員」という。）に対する教育及び訓練の実施並びに知識及び技能の確認（以下「教育及び訓練等」という。）は、実施要領を定めて行うことと規定しているが、実施要領に実施に関して必要な事項を規定していないことを確認した。また、教育及び訓練等の記録が保存されておらず、実施状況を把握し、管理できる状況でないことを確認した。よって、運転係員に対する教育及び訓練等に関する内容を実施要領に規定すること。また、教育及び訓練等の記録を保存するとともに、適切に実施状況を把握し管理すること。この指示に従わず、安全管理体制の改善が確認できない場合や、再び違反行為があった場合には、以下のとおり、事業の改善を命ずる場合がある。（１）事業改善命令を行使し得る根拠となる法令の条項（行政手続法第３５条第２項第１号）鉄道事業法第２３条（２）上記の条項に規定する要件（行政手続法第３５条第２項第２号）鉄道事業法第２３条の鉄道事業者の事業について、輸送の安全その他公共の利益を阻害している事実があると認められること。（３）当該権限の行使が上記の要件に適合する理由（行政手続法第３５条第２項第３号）輸送の安全その他公共の利益を阻害している事実が確認され、鉄道事業法第２３条第１項第３号及び第６号で定める措置を講ずる必要があるため。以上【関東運輸局】
