令和５年１月２５日から１月２７日まで、貴社に対して保安監査を実施したところであるが、監査の結果、改善を要する事項が認められたことから、下記の事項について、改善措置を講ずるよう指示する。 講じた措置については、令和５年３月３１日までに報告されたい。 記 以下の事項の改善措置を講ずるにあたっては、発生した背後要因を含めて原因を究明した上で、再発防止のための措置を講ずること。 １. 列車又は車両（以下「列車等」という。）を操縦する係員に対して行う身体機能検査について、次の（１）及び（２）の内容を確認した。 （１）社内規程に基づき実施している医学適性検査において、動力車操縦者運転免許に関する省令（以下「動免省令」という。）第８条の２（身体検査）別表２に掲げる視力を含む身体検査基準を下回る結果が乗務員指導管理者及び運転管理者に共有されていたにもかかわらず、再検査の指示等の必要な措置を講じずに列車等の操縦業務に従事させていたこと。 （２）労働安全衛生法第６６条及び労働安全衛生規則第４５条に基づく特定業務従事者健康診断において、動免省令第８条の２別表２に掲げる視力の基準を下回る結果となった者がいたにもかかわらず、必要な適性を保有していることを確認せずに列車等の操縦業務に従事させていたこと。 よって、列車等を操縦する係員が作業を行うのに必要な適性を保有していることを確実に確認するとともに、適性を保有していないおそれがある場合には適切な措置を講じ、必要な適性を保有していることを確かめた後でなければ列車等の操縦業務を行わせないよう管理体制の見直しを行うこと。 ２.列車等の運転に直接関係する作業及び車両の保守作業に係る業務を平成２２年４月１日に委託したことに伴い、安全管理規程に定める業務の受委託に関する事項に変更が生じたものの、鉄道事業法第１８条の３及び鉄道事業法施行規則第３６条の２第４項に基づく安全管理規程変更届出書が当局に提出されていないことを確認した。 よって、速やかに安全管理規程の変更について当局に対し提出するとともに、法令に基づく手続きが確実に行われる体制を構築すること。 【関東運輸局】
