当該建設業者は、大阪市内の民間工事において、建設業法第３条第１項の規定に違反して建築工事業に係る同項の許可を受けないで建設業を営む株式会社大樹と下請契約を締結した。また、本件工事において、同項の規定に違反して建築工事業に係る同項の許可を受けないで建設業を営む株式会社Ｒｅｇａｌｏと下請契約を締結した。 また、本件工事において、同法第22条第２項の規定に違反して、株式会社大樹から同社の請け負った建設工事を一括して請け負った。また、本件工事において、同条第１項の規定に違反して、その請け負った建設工事を一括して株式会社Ｒｅｇａｌｏに請け負わせた。
