東伸エンジニアリング株式会社の元役員は、大分県別府市が平成31年2月5日から7日までの間に入札を執行した浄水場機械設備工事の機械設備仕様の策定に関して、別府市元職員が当該業者に便宜を図ったことの謝礼及び当該元職員から今後も同様の取り計らいを受けたい趣旨の下に、現金100万円を供与したとして、令和3年3月18日、大分地方裁判所より、贈賄罪の有罪判決を受け、その刑が確定している。 このことが、建設業法第28条第1項第2号及び第3号に該当すると認められる。
