藤友工業株式会社が一次下請として請け負った北海道二海郡八雲町におけるトンネル工事現場において、平成30年7月17日、トラクター・ショベルを用いて路盤整地作業を行っていたところ、作業員1名がひかれ死亡した。 この事故をうけ、運転中のトラクター・ショベルに接触することにより労働者に危険が生ずるおそれがあったにも関わらず、機械等による危険を防止するため必要な措置を講じなかったとして、当該業者及び当該業者元社員１名が、令和2年12月11日、函館簡易裁判所より労働安全衛生法違反により略式命令（当該業者及び当該業者元社員1名にそれぞれ罰金20万円）を受けた。また、トラクター・ショベルを運転していた当該業者元社員が、安全確認不十分のまま漫然と後退した過失により、後方にいた作業員をひいて死亡させたとして、令和2年12月9日、八雲簡易裁判所より業務上過失致死罪の略式命令（罰金50万円）を受けた。上記略式命令による刑は確定している。 このことが建設業法第28条第1項第3号に該当すると認められる。
