当該建設業を営む者は、泉大津市内の民間発注工事において、有限会社川下工務店に対し本件工事に係る代金（500万円以上）を請求し、同社から支払われた代金の一部を施工業者であるBに支払った。なお、有限会社川下工務店は本件工事を当該建設業を営む者に請け負わせたとの認識であった。このように、当該建設業を営む者は、本件工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで請負代金の額が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。
