株式会社佐藤企業の元代表取締役副社長が、土木建築工事の杭打ち工事を落札できなかったことを理由に、令和2年4月13日に建設会社の支店において前記杭打ち工事を株式会社佐藤企業に受注させることを要求し、その実行について、上記建設会社の従業員らに対し株主権を行使する態度を示し、その実行について、威迫の行為を行ったとして、株式会社佐藤企業の元代表取締役副社長が、会社法違反により令和2年7月13日に東京簡易裁判所から罰金刑の略式命令を受け、この刑が確定している。 このことが、建設業法第28条第1項第3号に該当すると認められる。
