１ 当該建設業者の建設部に所属する労働者Aは、兵庫県内に所在するマンション新築工事現場の現場代理人として同現場に設置する足場に係る機械等設置届の届出義務を負う者であるが、労働者Ａは、当該建設業者の業務に関し、当該建設業者が請け負った同工事において、令和３年７月26日に、組立てから解体までの設置期間が60日以上、高さ10メートル以上の足場を設置しようとする計画であったのであるから、その計画を同足場の設置工事開始の日の30日前までに、法令で定めるところにより、西宮労働基準監督署長に提出しなければならなかったのに、法定の除外事由なくこれを提出しなかった。 ２ 当該建設業者の取締役兼建設部部長で労働安全衛生上の責任を有する取締役Bが、同人は当該建設業者の業務に関し、第一、兵庫県内に所在するマンション新築工事計画の現場代理人として同現場に設置する足場に係る機械等設置届の届出義務を負う者であるにもかかわらず、その足場の計画を、令和３年11月18日までに、法令で定めるところにより、神戸東労働基準監督署長に提出しなければならなかったのに、法定の除外事由なくこれを提出しなかった。 第二、大阪市内に所在するマンション新築工事の現場代理人として同現場に設置する足場に係る機械等設置届の届出義務を負う者であるにもかかわらず、その足場の計画を、令和３年９月６日までに、法令で定めるところにより、大阪中央労働基準監督署長に提出しなければならなかったのに、法定の除外事由なくこれを提出しなかった。 １及び２のことで、当該建設業者は、労働安全衛生法（昭和47年法律第57号）違反により、罰金40万円の刑に処せられ、２のことで、当該建設業者の取締役Bは罰金20万円の刑に処せられ、令和４年10月21日にその刑が確定した。
