当該建設業者は、大阪市内の営業所の電気使用料金が毎月400円程度であるなど、営業所をほとんど使用せず、建設業法第７条第２号に規定する営業所の専任技術者である当該建設業者が、一定期間、当該営業所に出勤せず、当該営業所において専らその職務に従事していない状態にあった。 そして、このような状態にあることを当該建設業者が請け負った大阪市発注工事及び泉佐野市内の大阪府発注工事において、注文者に伝えていなかった。 このように、建設業法第７条第２号に規定する営業所における専任技術者である当該建設業者がその営業所に常勤して専らその職務に従事すべきところ、同号の規定に違反して、一定期間、専任しているとは認めがたい状態にあった。
