被処分者は、令和６年２月に、建物２戸の売却について、所有者から依頼を受けて、建物ごとに、それぞれ専属専任媒介契約を締結した。これらの業務のいずれにおいても、①宅地建物取引業法第３４条の２に定める書面（媒介契約書）に建物状況調査を実施する者のあっせんの有無を記載せず、②指定流通機構への登録をしなかった。これらのことは、①は、同法第３４条の２第１項第４号に違反し、②は、同法第３４条の２第５項に違反する。
