当該建設業者の当時の代表取締役A、B団体大阪府本部C支部事務局長及び同本部理事兼同支部支部長３名は、当該建設業者の業務に関し、D社が施工するE地区土地区間整理事業における解体・土木・造成工事に関し、D社と交渉し、解体工事の一部を二次下請として当該建設業者に受注させていたが、前記解体・土木・造成工事により深く関与するため、D社に当該建設業者が受注した解体工事現場近くにある盛土の撤去に関する作業計画の変更や土木・造成に関する施工計画の開示を迫ろうと考え、共謀の上、D社の解体造成作業所において、D社従業員に対し、「お前、現場止めてしまうぞ、こら。」、「こっちが前から頼んでるんで、な。こんな所から見積りも出てんでって話もしてるんやで。こっちに見積りすらやらせへんのか、と思う。」などと怒号して、盛土の撤去に関する作業計画の変更及び土木の造成工事に関する施工計画の開示を要求し、もしその要求に応じなければ、前記解体工事等を妨害し、前記D社及び前記D社従業員の名誉、財産等に危害を加えかねない気勢を示して、同人を怖がらせ、もって同人に義務のないことを行わせようとしたが、前記D社従業員が警察に届け出るなどしたため、その目的を遂げなかったものである。 このことで、Aは、刑法（明治40年法律第45号）第223条第１項及び第３項の罪により、懲役１年執行猶予３年の刑に処せられ、令和６年９月20日にその刑が確定した。
