丸稲興業株式会社は、長岡市立川崎小学校管理・特別教室棟屋上の防水用塩化ビニールシートを更新する「川崎小学校屋上防水改修工事」の元請負人である。 当該工事において、令和６年９月９日に下請負人の労働者が、高さ11メートルの作業場であった建物３階屋上南側において、手すり等の墜落防止措置が講じられていない状況下で、作業を行っていたところ、作業床の端から墜落し、頭蓋骨粉砕骨折により同日に死亡する事件が発生した。 このことから、法人及び同社代表取締役が、労働安全衛生法違反により罰金刑に処され、令和７年1月22日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
