間宮塗装が請け負った常光寺屋根補修塗装工事において、令和2年3月30日、高さ約3.8メートルの同建物の屋根上にて、トタン製の屋根瓦補修作業を行っていたところ、工事等関係者1名が墜落（死亡）する事故が発生した。 この件について、墜落により労働者に危険を及ぼすおそれがあったのに、足場を組み立てる等の方法により作業床を設けず、もって労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じなかったとして、間宮塗装代表者が、労働安全衛生法違反により、新発田簡易裁判所から罰金刑を受け、令和3年1月5日にこの刑が確定している。 このことが建設業法第28条第1項第3号に該当する。
