有限会社おおく建設は，令和2年1月28日，元請として請け負った鹿児島市内の牛舎改修工事において，トラクターショベルの乗車席以外の箇所に労働者2名を乗せて作業をさせており，危険防止措置を講じなかった。 さらに，同作業中に労働者1名が負傷し4日以上休業したにも関わらず，所轄の鹿児島労働基準監督署長に対し，遅滞なく，労働者死傷病報告を提出せず，法定に定める報告をしなかった。 この件について，同社及び代表取締役らは，労働安全衛生法違反により，鹿児島簡易裁判所からそれぞれ罰金の略式命令を受け，令和3年4月5日に刑が確定した。 このことは，建設業法第28条第1項第3号に該当するものである。
