福本総業は、令和3年1月12日、長崎県西彼杵郡長与町高田郷の工事現場において、福本総業代表者が労働者に足場の倒壊を防止するためのロープを足場に張る作業を行わせるに際し、スレート屋根の踏み抜きにより労働者に危険を及ぼすおそれがあり、同屋根に幅が30センチメートル以上の歩み板を設け、防綱を張る等踏み抜きによる労働者の危険を防止するための措置を講じなければならなかったにもかかわらず、その措置を講じず作業を行わせた結果、労働者がスレート屋根を踏み抜き約5メートル下のコンクリート地面に墜落し、出血性ショック等により同日死亡した。 このことにより、長崎簡易裁判所より、福本総業代表者は労働安全衛生法違反により、罰金20万円の略式命令を受け、令和4年1月29日にその刑が確定した。 このことが、建設業法第28条第1項第3号に該当し、監督処分の対象となる
